Welcome to The Nautical Guy’D (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, www.thenauticalguyd.com (the “Website”), and participation in our coaching programs and related services (“Services”). By accessing this Website, registering for a course, or using our Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility and Enrollment

Enrollment in our coaching programs is open only to individuals preparing for examinations conducted by the Mercantile Marine Department (MMD) in India. You must already hold, or be in the process of obtaining, a valid Certificate of Competency (COC) to be eligible. Enrollment is strictly personal and non-transferable. Any misrepresentation in eligibility or identity may result in cancellation of your enrollment without refund.

During enrollment, you will be required to provide copies of your CDC and/or COC (if applicable). These documents will be used solely for the purpose of verifying your identity, ensuring eligibility to attend the live classes, and cross-checking your details in the official DG Shipping database. This process is strictly to confirm that you are a bona fide seafarer enrolling for exam preparation. All documents submitted will be handled with the highest confidentiality, stored securely, and never disclosed to any third party except as required by law.

2. Nature of Services

Our coaching programs consist primarily of live, interactive, online sessions delivered through secure video conferencing platforms. The focus is on verbal instruction, discussion, and guidance. Limited notes or pre-prepared study material will be provided for a limited time after the course ends.

3. Technical Requirements

Participants must ensure access to a laptop or desktop computer with a stable internet connection (minimum 10 Mbps recommended), a functioning webcam, and a microphone. For monitoring and verification, cameras must remain switched on throughout all sessions. Access through mobile phones is not permitted under any circumstances. Failure to meet these requirements may restrict participation and will not entitle you to refunds or alternate sessions in a future batch.

4. Payment Terms

All course fees must be paid in advance through the approved payment methods specified (Bank Transfer, UPI, NEFT, IMPS, or other approved modes). Fees are non-transferable and subject to revision at our discretion. The applicable fee is that prevailing at the time of your confirmed enrollment.

5. Refunds and Rescheduling

We maintain a strict no-refund policy. Once payment has been received, fees are not refundable under any circumstances. Participants may request rescheduling to a later batch subject to availability and compliance with the timelines set out in our Refund & Rescheduling Policy (see dedicated page). Any increase in course fees applicable at the time of rescheduling must be borne by the participant. Requests for rescheduling must be submitted by email only and within the prescribed notice period.

6. Attendance and Conduct

Participants are expected to attend all scheduled classes and maintain professional conduct. Disruptive behaviour, abusive or derogatory remarks, refusal to keep the camera switched on, or violation of our policies may lead to removal from the batch without refund.

Only the registered candidate may attend the course. Each participant must log in from their individual device; shared or group access is strictly prohibited. IP addresses and login records may be monitored. Any misuse of access, including sharing credentials or unauthorized attendance, will result in immediate cancellation of enrollment without refund.

7. Intellectual Property Rights

All intellectual property associated with the course content, instructional methods, examples, website text, design, and any materials provided before, during, or after sessions remains the sole and exclusive property of The Nautical Guy’D. Participants are strictly prohibited from recording, copying, reproducing, sharing, distributing, publishing, or otherwise making available any part of the course materials or sessions in any format without prior written consent.

Each participant’s access includes a unique digital watermark or identifier traceable to their enrollment, and any unauthorized screen recording, capture, or distribution will result in immediate termination of access, forfeiture of fees paid, and initiation of strict legal action under applicable intellectual property and cyber laws. Additionally, the system actively monitors user login activity, including IP address tracking, to prevent account sharing or unauthorized access; if access from multiple or conflicting IP addresses is detected, the participant’s access will be revoked without notice and legal proceedings will be initiated.

8. Limitation of Liability

We make no guarantees regarding examination results or outcomes. Success depends on each participant’s individual preparation, effort, and the standards applied by the relevant authorities. To the fullest extent permitted by law, we disclaim liability for any direct, indirect, incidental, or consequential loss or damages arising from your use of our Services.

9. Privacy and Data Protection

We are fully committed to the security and confidentiality of your personal information. All personal data collected during enrollment or use of our Website, including but not limited to identity details, contact information, and verification records, will be stored securely and used strictly for the purpose of delivering our Services.

Your information will never be sold, shared, or disclosed to third parties, except:
(a) where required by law or government authority; or
(b) where necessary for verification with official seafarer databases (such as DG Shipping) as part of enrollment.

We employ reasonable administrative, technical, and physical safeguards to protect your data against unauthorized access, disclosure, alteration, or destruction. By enrolling, you consent to such verification and secure handling of your information in accordance with our Privacy Policy.

Any attempt to falsify details or misuse the enrollment process will result in immediate cancellation without refund, and relevant authorities may be informed.

10. Third-Party Services

Our website may contain links to third-party websites or services. These are provided solely for convenience. We do not control, endorse, or assume responsibility for the content, policies, or practices of third-party sites.

11. Force Majeure

We shall not be held liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, platform failures, regulatory changes, strikes, pandemics, or government restrictions.

Classes will follow the published timetable to the best possible extent. However, due to unforeseen circumstances, sessions may be rescheduled (including on Saturdays/Holidays) or timings may be adjusted, with prior notice and in consultation with the majority of participants.

12. Termination of Access

We reserve the right to suspend or terminate your access to the Website or Services at our discretion if you breach these Terms, engage in misconduct, or misuse our intellectual property. No refunds will be issued in such cases, and we may pursue legal action if necessary.

13. Amendments

We may amend or update these Terms at any time. Updates will be posted on this Website with a revised effective date. Continued use of the Website or Services constitutes acceptance of the amended Terms.

14. Errors, Omissions, and Guidance Disclaimer

While we take all reasonable care to ensure that the information delivered during classes and provided outside of class (including guidance, advice, and course discussions) is accurate and up-to-date, inadvertent errors or omissions may occur. All content should be considered as guidance only and does not constitute professional or legal advice. The Nautical Guy’D makes no warranties or representations regarding the completeness, accuracy, or reliability of such information and shall not be held liable for any loss, damage, or inconvenience arising from errors, omissions, or reliance on the guidance provided. Participants are responsible for verifying critical information independently and applying their discretion when acting on any guidance offered.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India. Any disputes arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in Maharashtra.
